Terms and Conditions for Renting the Holiday Home “The Moments Cottage” on the Island of Kaprije, Croatia

  1. Scope
    These Terms and Conditions govern the contractual relationship between the tenant and the landlord of the holiday home “The Moments Cottage” on the island of Kaprije, Croatia. By booking the holiday home, the tenant fully accepts these Terms and Conditions.
  2. Booking and Contract Conclusion
    2.1. Booking can be made online via the website, by email, or by phone.
    2.2. The contract is only concluded once the tenant has paid a deposit of 30% of the total rental price and the landlord has confirmed this in writing.
    2.3. The tenant is required to verify the accuracy of the booking confirmation and payment confirmation and to inform the landlord immediately of any discrepancies.
  3. Payment
    3.1. A deposit of 30% of the total rental price must be paid within 4 days of receiving the booking request.
    3.2. The remaining amount is due no later than 30 days before arrival.
    3.3. For last-minute bookings (less than 30 days before arrival), the full amount is due immediately upon receipt of the payment request.
    3.4. If payment deadlines are not met, the landlord is entitled to cancel the booking. In this case, the cancellation conditions according to Section 5 apply.
  4. Prices and Services
    4.1. The services included in the rental price are detailed on the website.
    4.2. The rental price includes the use of the holiday home, including ancillary costs such as electricity, water, and final cleaning, unless otherwise stated.
    4.3. Additional services (e.g., boat rental, extra cleaning) must be booked and paid for separately.
  5. Cancellation Conditions
    5.1. The tenant may cancel the booking in writing at any time before the start of the trip.
    5.2. In any case, the deposit of 30% of the total rental price will be retained and is non-refundable.
    5.3. For cancellations up to 60 days before arrival, no further payment is required.
    5.4. For cancellations less than 60 days before arrival, the entire rental price is due.
    5.5. The tenant has the right to provide a replacement tenant who will take over the booking under the same conditions. In this case, the deposit will be transferred to the replacement tenant.
  6. Arrival and Departure
    6.1. The holiday home is available to the tenant from 4:00 PM on the day of arrival.
    6.2. On the day of departure, the holiday home must be vacated by 10:00 AM at the latest.
    6.3. Early or late arrival or departure requires prior arrangement with the landlord and may incur additional costs.
  7. Use of the Holiday Home
    7.1. The holiday home may only be occupied by the number of persons specified in the booking.
    7.2. The tenant agrees to handle the holiday home and its inventory with care and to report any damage to the landlord immediately.
    7.3. Pets are only allowed with prior agreement from the landlord.
    7.4. Smoking in the holiday home is not permitted.
  8. Liability
    8.1. The landlord is not liable for damages caused by force majeure, such as natural disasters.
    8.2. The landlord is not liable for personal belongings of the tenant.
    8.3. The tenant is liable for all damages caused by them or their accompanying guests to the holiday home or its inventory.
  9. House Rules
    The tenant agrees to comply with the house rules, which are posted in the holiday home.
  10. Data Protection
    The personal data collected during the booking process will be used solely for contract execution and will not be passed on to third parties.
  11. Severability Clause
    If any provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision will be replaced by a valid regulation that most closely reflects the economic purpose of the invalid provision.
  12. Jurisdiction and Applicable Law
    12.1. Austrian law applies to all disputes arising from or in connection with this contract.
    12.2. The place of jurisdiction is the landlord’s place of residence.
